How Making a Movie Could Keep You Out of Jail Op-Docs

Our job is to make judges suffer. Thats the view of Doug Passon, a defense lawyer and expert in creating short, tear-jerker documentaries to win lenient sentences for his clients. Passon is also the subject of this weeks Op-Doc No Jail Time: The Movie, by Lance Oppenheim. Oppenheims previous Op-Doc was the eerily humorous Long Term Parking, about airline workers living in an airport parking lot; this time, he peers into a strange subculture of lawyers immersing themselves in the art of documentary storytelling.

These are incredibly manipulative of judges. Sure, they gave examples of arguably decent people who don't necessarily need to be in the prison system and committing a crime was what they felt was their only option. But that first case didn't sit with me well. He was a potentially abusive boyfriend, who kidnapped someone and took her across state lines? That is dangerous. Letting that person go with only 3 months because they had the money to pay a lawyer and make a sob story movie about them is endangering the public. People with the money to pay for more expensive defense attorneys who will make a movie about how they don't deserve prison means wealthy people have yet another out from crimes committed, and attorneys line their pockets.
The real fix would be overhauling the justice system to have more detailed and standardized criteria for what crimes face what punishments, changing how non-violent crimes are treated, and banning these silly videos and bail/bail bonds that basically let people with enough money get away with whatever they want.

Everybody keeps saying that this isn't justice or its manipulation. So that means justice is always right? If thats the case then why do black men go to prison way more than whites. For the same crimes. Its because the judge doesn't see themselves. All he sees is a black person who he doesn't relate to. These films just show the judge he is a human being who made a mistake. Someone who has never been given the same advantages and opportunities in life that others have.

What the actual! Part of your legal package, if you can afford it, is a glossy post-conviction video designed to elicit a more lenient sentence for your crimes. Meanwhile, defendants represented by public defenders are pressured into plea deals and never have that option. Just take the blindfold off the statue of Justice and throw some dollars on her scale. That's what this tactic represents.

Guess who can afford to hire someone to make these nice little films about them? Affluent people. Nice Justice system, America.
Of course there ought to be way more empathy. However this just rewards storytelling, showmanship, acting.

1: 46 - o.
3: 20 - Wow, not exactly a room full of Glove And Boots fans there, huh? No wonder Passon had to ply them with alcohol and implore them to have some fun. Love his uncomfortable throat-clear after the video.

So basically just show the accused as young and smiling in photos, make the judge and jury feel sympathy, and a nice happy soundtrack and completely gloss over the crime they committed. JUSTICE?

I kept waiting for this to turn into an expose on an abuse and perversion of the justice system, accessible to only those that can afford it. Instead, it was a celebration of it.
