Dig into the complicated history of divorce from the earliest known divorce laws in ancient Mesopotamia to modern day. Formally or informally, human societies across place and time have made rules to bind and dissolve couples. The stakes of who can obtain a divorce, and why, have always been high. Divorce is a battlefield for some of society s most urgent issues, including the roles of church and state, individual rights, and women s rights. The Islamic way to get divorce is not explained in enough detail:
An Islamic judge may issue a divorce against the husband's will if:
- Her husband does not spend on her
- Her husband deserted her for a year
- Domestic violence
-Apostasy
(Also some scholars say that it is permissible for the judge to force the husband to agree to the request and some say it's permissible for the wife to stipulate that the husband divorces her when she gets married)

Ted ed didn't point the main issue which is that women usually stop working after marriage and it would become difficult for them to handle life post divorce as children would tend to live with mother and mother isn't skilled enough to earn a livelihood so life becomes very difficult for women
So these divorce laws should be more biased towards women's side than men's

reply

The part about Islam is inaccurate, women can divorce through legal intervention, even without the agreement of the husband.
And in Shafi'ii fiqh, I believe that women can divorce even without legal intervention and the husband's agreement (though for that I can't find the sources)

Hey so this may sound silly but I ve noticed this thing recently while getting into period dramas. Could you maybe do a video explaining what a promenade is? Like I understand it s a walking area but why is it so important?

Fault-based divorce really overstayed it's welcome. Good thing it was abolished in the 1960s
British people who won't have no-fault divorce until the end of this year: open weeping

That music while explaining India's situation, so stereotypical. And the one liner was obviously quite unfair to describe complex the social and legal aspect of divorces in India.

Is it just me or there was no background music during American and European sections and suddenly there s a tabla playing in the background when you speak about India.

Divorces are sad but they NEED to exist. People being stuck together with people they're no longer happy with has to be really miserable for every party involved

As a divorce attorney, the first thing I ask all my clients is, Do they squeeze the toothpaste in the middle? It helps add criminal charges to the dispute.

I would say it is also an issue of men's rights. Since many laws regarding divorce or domestic violence often privilege women.
Excellent video! :)
