There are some major flaws in you're theory.
First if the government had the power to make people super wouldn't they also have the power to remove them, and for that matter rather than just outlawing superheroes why not make it mandatory for supers to report to where they got there powers to get them removed.
Also if Benny had superhero parents why wasn't he born with powers, and if Edna has super powers why doesn't she use them, and if the point was that her brains where her super power, and she uses it to make tools, and outfits for supers then wouldn't that make Benny/Sindrome a super to?
I mean yeah Edna's powers are more powerful because she received them directly, and Benny inherited his, his powers where slightly deluded, but he still had brains.

Also if the government had the ability to give people super powers why leave Benny out, if him becoming a super Villon is a direct result of his hero parents not having time for him why not give him powers so he'd grow up in the hero business with his parents?
1 positive you can take from Syndrome is that the government learned there lesson, if you are going to give out super powers make it more inherent, and hereditary so it doesn't separate families.
