I've seen a documentary about the origins of Japanese people and where they are came from. It stated there that the first settlers In Japan were not actually Asian, but a mix of Middle Eastern and European people they are called Ainu and settled in Northern Japan. As probably most of people knew Ainu are the indigenous people of Japan and looked very different from the Japanese as we all know today. Those Japanese that we know about are the Yamato people and it is stated that they are originally, Jeoseon (Korean) people. They dominated the existing settlers in Japan pretty much like the white americans dominated the native Americans.

Trial by ordeal seemed to have been a very effective way of determining guilt. If people really belive that the gods would help or not a person guilty of a crime especially ones that won't get the death penalty would never take the trial. After all to them it was having a burnt hand and having to pay up or joust pay up. The outhorities new this and often did not make the water hot enough to give burns.
Your innocence was not proven by the ordeal but by the fact you where willing to do it

Kirisute Gomen was the most common form of punishment by the samurai class upon peasants; simply beheading them to pay for whatever insult they might have perceived.
Putting heads on display at execution grounds continued into the late 1800's. In fact, samurai children (5-6 year olds) were sent to spend a night at the local execution grounds to prove their courage.

Thank you for this documentary. I have trouble reconciling the Japan that abolished the death penalty and slavery with Imperial Japan that raped and beheaded its way across the pacific and Asia in the 30s and 40s.
Did these laws apply only to Japanese people, while all foreigners were considered subhuman?

Was the death penalty only banned for the nobility or was it banned for the peasantry as well? I know a lot of feudal and nobility systems had a different punishments for the different classes.
