During the mid-18th century, murder was so rampant in Britain that Parliament needed to create an equally brutal law in response. Some said legislation as a fate worse than death. The British Murder Act of 1751 became law the following year, with the purpose of terrorizing the public into a reasonable facsimile of human decency. Gosh, turns out when masses of people are forced to live in abject poverty with little to no chance of improving their lives while the rich and powerful flaunt their wealth and commit vast sums to endless, pointless wars, the violent crime rate skyrockets. I'm so glad these exact same conditions could never happen now, right?

I'd love to know if crime went down because of this law or because the lot to the 'common people' improved, removing their need to commit crimes. They no longer had, 'nothing to lose'.
That's like claiming Giuliani's draconian policing laws in New York back in the 80s is what reduced the crime rate rather than the fact the economy with taking off with the crime rate decreasing even before he passed the laws (still took credit of course.

My father claimed that capital punishment didn't work as a deterrent because it wasn't strict enough. He didn't know about this (the BMA)--at least I don't think he did (I sure didn't before now)--but I wonder what he would have said had he known about it.

So it seems the places the British used as penal colonies went on to excel and matter on the world stage. Maybe we should do the same thing but send them to Africa or Haiti. Then, given a few decades, they could get their civilization back.

Parliament changed the law in regards to poaching. Poaching with a black face was punishable by hanging but poaching without a black face would only send a poacher to jail.

The problem with the death penalty for minor crimes, was juries and judges did not want to convict people which contributed to the lawlessness.
