Under international law, medics may carry weapons, but can only use them if engaged by unprovoked enemy forces. Should they initiate combat, they forfeit their status as non-combatants. The only implication here is that if the Player does decide to attack a Koopa Troopa, Mario is a war criminal as he has now attacked a non-combatant, and this also means the Koopa Troopa can fight back without losing non-combatant status
Note about using Cappy to possess enemy troops;
I have never played or watched the game thats from, but if enemy troops no longer attack you when youre in this form, a better fit is False Flag Warfare. The player completely takes over the body of the enemy, it no longer has its own consciousness which I would say disqualifies it as a hostage. In this case however, it is a disguise, and under the rules of False Flag Warfare, this is too a war crime. False Flag Warfare means that you must be easily identifiable and you must not identify yourself as anyone else this means you cannot;
1. Use unmarked uniforms
2. Use uniform markings of another country or territory
3. Use unmarked/incorrectly marked aircraft
4. Use unmarked/incorrectly marked naval craft
5. Use the guise of surrender to trick the enemy. If you attack after surrender, you forfeit the status of non-combatant and you forfeit the rights of surrender and protection under the Geneva Conventions.
On this list, No. 2 applies to the use of Cappy\r\n

9: 09 Nope sorry. Unagi has been dethroned as the scariest thing ever by Horrorboros in Splatoon 3. It screams like a person yelling thru a glitched out megaphone and it looks like some kind of horrific bioweapon science expirament. It doesn't even have pupils in its eyes. I legit had to take a moment after seeing it for the first time. Nintendo could make a good horror game if they wanted to. They already put obominations of nature in their kids games lol

Much like the USA, neither the Toadstool Kingdom nor the Koopa Kingdom are signatories to the Rome Statute and therefore the Conventions cannot be used against either of their militaries.
In a similar vein, Mario cannot be tried for war crimes because not only is he not a soldier for a state that submits to the ICC, he is not a soldier at all, he is a civilian.

I mean yeah they are civilians Bowser is the King of the koopas. Also do we need to mention that their are kings working in bowser's military? Does this mean that kings such as King Bomb-omb and King Goomba are just lords? Or even worse they are rulers of a nation which was conquered by bowser, their former troops, now working under bowser.

bowser has 4 legions under his command, The Spectral empire (King boo) The Frost Empire (Baron Brr) the Magma empire (King kaliente) and the bomb ombs (King bomb ombs) goombas, bullies, aspikes, etc are all PMCs. Koopas are the rank-and-file of the Bowser kingdom

Of both boos and dry bones can be enlisted in Bowser-s army, that suggests that a dead soldier is literally worth more to Bowser-s military than a live one. When a soldier dies, you can get two more soldiers in their place.

Mario is not subject to the geneva convention as he does not fit an organized military structure. I recommend you charge him in the mushroom kingdom or bowsers castle.
