Actually, it's a minefield for the buyer, even if not the usual uninformed victim. I don't know about TX at all, but, under the UCC, a dealer can waive the (implied) warranty of merchantability. As Is does actually mean that and the paperwork will usually use the specific word merchantability. Now, if a warranty of any kind is also bought within 90 days of the purchase, the implied warranty of merchantability cannot be waived. Some states completely prohibit as-is sales. Check to see if yours does. If you ask and the dealer denies defects of which an expert, i. e. the dealer, should reasonably be expected to know, you may well have cause of action. Take notes; have a witness. Call your state's dept. of consumer affairs and/or the AG's office to find out whether there have been complaints against that dealer. In general, NEVER buy from any dealer, only from actual private parties who OWN the vehicle and have service records. Look on line for problems with ANY car you're considering. Take a OBD II scanner with you and use it. All used car dealers are crooks. Protect yourself.

I bought a certified used vehicle from my Honda dealership (i. e, I paid a really solid price for the car. First car I purchased in my life. The car shredded through 4 sets of tires in about 80k miles. Drifted all over the place. By 105k miles (after replacing the timing belt) the engine completely blew. When I brought it in to a repair shop to see if there was anything they could do (nope, I was told the front end had been rebuilt, as if it had been in a serious collision. A lightbulb went off in my head: I had been completely screwed by my local Honda dealership. I hate Honda. I will never return to a Honda dealership in my life. (Do I blame myself? Sure I do. But I wrongly thought that by relying on Honda's reputation, I'd be okay. Hard lesson to learn)

A lot of greenbacks for a lot of milage. The car is well presented and looks the part. People think twice about paying a dime over the odds but when it comes to grands, aw shucks who cares. A third party, such as a mechanic, would have saved this customer a lot of grief. Prevention is always, I repeat, Always better than cure and easier on the wallet. People get ripped off every day and it's not pretty especially when the budget is curtailed. Appearances can be very deceptive and exceedingly so for the ordinary Joe public. Sincerely hope this person gets his money refunded and learns from his experience. Let this episode be a dire warning to all would be car owners in similar situations.

There is a sucker born everyday when non intelligent buyers go to a used car dealership. Especially these Buy here, pay here places. The dealer is guaranteed a sale as soon as they step onto the lot. The buyer of that Volkswagen could file a charge back with his bank, and the bank will forcefully remove the funds from the dealership and put it back into his account temporary until the investigation is complete. I'd still hire a lawyer also and take the dealership to court, because its possible that the bank can rule in the others persons favor.

Darn it would have to be an EOS I just trade my 2008 Sportster XL1200N at a bike shop for a 2009 with 95000 on it was the owners dads he had just bought his dad a new Lexus the EOS seems to be in flawless shape so far with new Michelin's on it, my over riding thought is if they put Michelin's on it they must have taken care of it but you got me thinking of trying to sell it and get a corolla i have enjoyed the luxury of it most of my rides have been banger's to date like you I've never owned a new car

Have a question for Scotty. Scotty encourages people to get a good, independent mechanic to look at a used car before a person purchase it. I live in a state where used cars need to go through a state inspection before they are sold from a used car lot/dealership/or are sold from one private party to another. In that case, is it still advisable for a car to be looked at by a independent mechanic before a person buys a used car that's already been state inspected?

How do we get a mechanic to look at a used car before buying? Especially if we don't know any mechanics personally? Will a mechanic at the dealer be willing to check the car and actually have the consumer's interest at heart? Can you ask a mechanic to come to the dealer to look at the car and pay them for their time? I'm just not sure how that would work

That's when you walk out the dealer hahaha
